More Bad News for Anna Nicole Smith

The U.S. Court of Appeals for the 9th Circuit in San Francisco has once again rejected all claims made by former stripper Anna Nicole Smith against E. Pierce Marshall. In December 2004 a three-judge panel overturned an award of $88 million to Smith. This week the court rejected Smith’s appeal for a rehearing en banc by the full 9th Circuit.

Today’s decision by the Supreme Court to hear this case is based on one issue, the probate exception. The Supreme Court’s decision to hear the case is not a reversal of the 9th Circuit’s opinion. We believe that the 9th Circuit Court of Appeals opinion is the correct interpretation of that law. We will pursue the case vigorously before the high court.

Judge Reprimands Howard K. Stern for Violating Court Order

Jurors in the Houston Probate Court may have wondered why an attorney for Anna Nicole Smith suddenly began sitting in the audience in the rear of the courtroom instead of with his client and the other attorneys at counsels’ table trying the case. The reason is that Judge Mike Wood became enraged when Stern confessed to the blatantly unethical, fraudulent and unauthorized use of confidential financial documents which were protected by a known, legally binding confidentiality agreement and which Stern pilfered from the courtroom to use in another case.

On January 31, 2001, when Anna Nicole Smith (Ms. Marshall) began making up stories under oath and quoting the findings of a California Bankruptcy Court from the witness stand, Harris County Probate Judge Mike Wood took her to task and threatened her with perjury charges. The jury had been excused.

J. Howard Marshall II (J. Howard) died with an estate plan in place that he and his attorneys carefully crafted over many years. When a Texas jury discovered attacks on the plan were based on a series of lies and false charges, they punished both plaintiffs in the case. J. Howard Marshall III (Howard, Jr.) was hit with penalties totaling more than $36 million and Anna Nicole Smith (who was protected from a larger penalty by the bankruptcy court) was hit with $541,000 in legal fees for as one defense attorney put it “bringing a lie to the courthouse.”

Judge Wood issued his final judgment today.
